I agree that the renter should have taken action to limit his losses. But that doesn't mean he has to combine it right away, it does mean he needs to take action if the cattle are still in the field causing more damage. Call the sheriff and get it taken care of. Yes that is a messy way to deal with it, but the owner sounds like he is unable to take care of his cattle. A reasonable person would assume that if a land owner knows his cattle are out then he will round them up and pay for damages they caused. By leaving the cattle on the loose after he (the cattle owner) knew they were out he has accepted the liability for the damages. Collecting for the damages might not be easy though. Yes, the land owner could ask if the crop could be harvested earlier, but the tenet doesn't have to accomodate him.
