I had the exact thing happen last fall. I asked the landlord if he had notified the current tenant. He said no. I told him I wasn't interested as long as they still had it. He ended up working out whatever problem he had with the tenant and I missed out. It would have been a good addition 1/2 mile down the road, but I'm still proud of my decision.
