| Agree. You stated in the original post that the landowner agreed to share negligence. I would ASK him if he would be comfortable paying your deductible. You could press the issue and possibly get him to pay all of the damage and it may be that you win that but lose the farm or you could lose both and end up paying anyway. Maybe you don’t care if you keep or lose the farm? If you keep farming it maybe negotiate in something for damages if you continue custom farming it and this might get him to change to rent? | |
