Around here it is the custom operator who is responsible for the repairs and would/should be insured for such. Sure, the OP had hidden treasures but I find them all the time and chalk it up as cost of doing business. Insure the machinery and like one other poster said, keep an eye out as best you can. You can't get all worked up over machinery. It's just machinery..... It is a crappy deal all around? Absolutely and my breakfast came up a little bit looking at it. But at the end of the day.... It's just machinery..... Hindsight is 20/20 but I won't pull into a field doing custom work if it was cleared and no tilled. I have broken out many pieces in my short time here and I have never once not found a treasure. This is why we moldboard plow it. If there's something hidden, you know it's there. Tree stumps are the most common. Guys get super lazy and cut them off at the ground when the office tells them they need to maintain their CRP. Then they rent it out after the CRP contract is up to some poor unsuspecting idiot (me) and he gets the pleasure of breaking it out. I've found stumps, wood posts, t posts, my favorite is the step in posts, a whole chain from a manure spreader, full car axle, various garbage, and the list goes on. I think best case you turn it into both insurance companies. His and yours. And let them fight it out themselves. Split the deductible for whichever insurance it goes to. I would think in no way would Deere be on the hook for any of it because the damage, I would consider, is not the fault of the machine. |
