Sure he did. He built bins and buildings on the home site that he does not own. Now his brother has leverage to dictate the terms of dividing the estate, because he knows it is hard to move bins and buildings and develope a new home farm site. I do agree it would have been better for the parents to itemize the will in this case with the attitude these two siblings.
His brother has leverage on nothing. his brother will get half of what the farm brings when it sells , unless he buys it. Which doesn't sound likely since his wife won't let him buy it.
By not getting things settled for four years the non farm brother has increased his net worth by a sizeable amount Vs if things had been settled four years ago. Non farm brother needs to wise up and cash in @ current land values, as it would more than likely be in his best interest long term. With what the cash would bring on int vs renting his half of the farm. |
