However if you get a government agent who is having a bad hair day (or period) it is possible for both of you to be charged with criminal conspiracy... You may beat the charges but will spend bo-ku bucks on lawyers...
Go to your employer and tell him that under the law you two are guilty of criminal conspiracy and he will convert you to W2 status TODAY and he will will pay to the government the withholding taxes due for 2010 and repay you for having paid his portion of payroll taxes for the previous six years that he has been unloading onto your back ( a criminal act)... Go to HR-Block and have the nice lady there calculate the amounts due...
This is a tough situation, I get the impression you are a straight shooter, and the farmer can wail all he wants about being picked on but he is an EMPLOYER and is required by the law to know the law - and follow it...
And be prepared to look for a job...
