You are absolutely correct that after the final plant date, it is up to the INSURED whether or not to take PP. The company cannot deny a claim because the crop could have been planted after the final plant date.
Now there are a couple conditions. One is that the farmer must have "proper equipment." This is not defined in any of the regs, but one probably could safely assume that a 15' 6 row planter would not be "proper equipment" for 5,000 acres of corn in most parts of the country. On the other hand having 2 60' 24row planters (and the associated equipment to use them) would be. Between that there is probably a lot of interpretation.
The other condition is that the cause of loss has to be general to the surrounding area and prevent other producers from planting. If you have 1/2 of your farm not planted and everyone else within many miles got everything planted, I would think you are at serious risk for having a claim denied. | |
