Nwmo | The problem when some one breaks into a house especially when your home whether they know it or not is that it becomes a life or death situation. You can't rely on the idea that a thief won't do you bodily harm because he just wants your valuables. The guy screwed up when he stopped the threat to his life by shooting them but then chose to finish them off. He either should have used a big enough caliber to finish them the first time he shot or called the police when they were down. We wouldn't know all this happened if he hadn't recorded it all. It maybe a reach but I can see how a juror would see pre meditation in his actions. He prepared his home for an intruder to enter and be caught, with his own audio tape he showed that he had an intent to kill and not just protect his property. I would say he was so fed up with being robbed his frame of mind was altered and It turned into a game/hunt that turned out bad for everyone.
