Thats what I gather from it too.

I can understand why biotech companies would want the protection. I don't think it is any different than a lot of what is going on in the courts today. Look at the WI voter ID law tied up in court, or the Gay Marrige thing in California that is in court now. The people (or in this case the USDA and FDA) approved it and then some group that opposes it can tie it up in court for any number of reasons for years, RR Alfalfa is a prime example the only people who won there were the lawyers.
