Once in a while I'll see an auction that gives possession before closing. Its almost always a timing thing vs the calendar, meaning a spring auction and the closing won't happen in time to get planted timely.
I would suspect that the down payment $'s would be sufficient to cover a years rent in the event that the buyer didn't follow through with the purchase.
As to the OP's situation, that is a question for the seller to be asking of a good lawyer. Probably not the one that created the mess.
