north central Iowa, Hampton | Mom and her second husband were both left widowed. They each had family and assets from their first partners. They each paid for half of their marital home and the pre-nup made it clear that they both went into this with the idea that the survivor of the marriage had the right to live in and maintain the house as long as they wished. At the sale of the house, the proceeds were to be split.
The pre-nup also made it clear that they both brought assets into the marriage and it was their intention that they didn't intend to co-mingle things as far as their respective estates were concerned.
I don't know if it would have stood up in court, but both families clearly understood what was expected. The document worked well for us. |
