Wouldn't some form of a trust be a better vehicle for asset protection premaritally plus the estate planning and long term care protections they may offer? Go into marriage with locked up assets uncontestable or essentially "asset-less on paper" for all intents and purposes with trust vehicles being estate planning to boot.
I assume each's kids would try to get their parent's spouse's property after potential separation or one deceased before the other as some states the spouse gets some portion of the deceased's assets.
While I like the idea of a trust, you have to have trustees that can be trusted. Do not underestimate the tricks that can be pulled. |
