Surface drainage (open ditch) the fella at the bottom end handles the most water, has the biggest deepest ditch, loses the most land, sufferers the most flooding when too much rain comes, etc.

Top guy should pay more, bottom end guy should pay less. Once established then maintenance of said ditch can be divided equally, as that comes out easier closer to fair.


Tile is different, everyone should share the same per acre of potential use, and put the dang main in big enough to handle all acres in that direction. And yes it’s very difficult to deal with those stubborn and unwilling to pay, but then decide to hook on a decade later. If they don’t pay now they should be blocked out or forced to pay up with interest later. How to do that, well good luck. Every, I mean every single time they see how much better the neighbors fields are, the tiling machine shows up and the backhoe is digging into the main......
