Get the first right on the ground. I did that with a neighbor that wanted to sell some but not all. We had lawyer draw it up, signed papers and gave him $500 earnest money and its a done deal. not a guarantee but I think it will work fine. Make sure it is filed and recorded at your court house so it goes with the ground if anyone does a search on it.
