For example I can have an investment of $10,000,000 that pays a 1% return and you can have a $10,000,000 investment that pays 20% return and upon death they would both be taxed the same. imo It is much better tax the return rather then worth of an investment.

I agree on that entirely. But with a couple hours of work people get to get away with NEITHER.... And said people are complaining that they need to do a days worth of work to AVOID taxes in general on large sums.
