I have an outside municipality that wants to take my farm through eminent domain. I've found out that eminent domain has a lot more teeth than it used to, but when it goes to court I'm confident I will win, just be poorer. They want to send surveyors out to survey my property which isn't for sale. Is there any way to legally keep them out? I have no issue with the surveyors, they are just doing their job, but it looks to me like in Illinois you have to just let them do what they want on your property even if it is against your best interest. I'd be curious if anyone else has had a situation like this and what they found out. I'm sorry I have to be vague about the situation.


I had this happen this past year, for a d@#$ lake housing addition. Only its a big main to a new sub. Pisses me off still, but long story short I took it to court. Half the jurors sided with us, other half said I didn't deserve it, that they pay for the light bill, and that was enough. I lost. Pre trial I was offered 30% over land price, now have very little to show for it, after I lost the 30% and lawyers fees. Not fair! I did get the no dig order recended, and maintain underground rights, just can't do anything within 10 foot of the poles. They were not initially allowing us any water or existing tile rights to drain. Now that 200 sq ac is split and borders the south end where planes can't get on fungidide. They made no offer to compensate. Not sure about Il, but In surveyers do have the right to be on your property. Best of luck
