If it has a determination, weather HEL, or NHEL, it is not considered "sodbusting". The term "sodbusting" only applies to land that doesn't have a HEL/NHEL designation. The only bearing HEL determination has on that land is how much cover you must maintain on the ground and when (spring or fall) you can do tillage. If the pasture is rough and needs tillage to smooth it out, then check with FSA/NRCS first, but I have never seen them balk at using tillage to break out grass.
