Were the recommendations given to you in written form (email, paper, text)? If not, you need to see if you can get the dealer to put in writing what he recommended. Otherwise it will be your word against his. I doubt he would give you an off-label recommendation in writing, because the liability would be huge, but it is possible.

Perhaps you asked him: "How much xxx herbicide do I need for 100 acres". In response, he sold you 100 gallon of xxx. The labeled rate of xxx is 32 oz per acre and he sold you enough to apply 128 oz per acre. This might be enough to prove that he recommended the 128 oz per acre rate, but I'm not a lawyer......
