Private companies can't eminent domain, but public utilities can for transmission needs etc. The public power companies have started to be affiliated with projects under development though by private developers. My concern is if at an impasse if they can claim in interest of public utilities. I'm just trying to know what their options/my options are while negotiating here. On our 'connect' line, it jogs around... some guys said yes, other's said no. It cost them a LOT to put all those corners in. So at THAT time, I believe they did NOT have power to pull eminent domain. The connect line is not 'public', not until the final connect transformer to put it into the federal highline. THAT 'switch yard' IS owned by the US govt.. and they 'friendly' condemned 12 acres of my pasture to erect it. |
