| Kansas has eminent domain also, but what our Attny told us, Westar is registered with the state as an energy provider and as such they do not have legal authority to condemn or threaten to condemn for a communications line.
In our case once we brought up that fact they just huffed and puffed a little bit and then it was like you let the air out of a balloon. That proved to me their entire purpose in our case was just to get the communication added to their easement.
Get a good Attny who knows property law and take nothing for granted. | |
