So if I’m understanding you correctly you’re saying this is kind of on me then? Because I was not told that this pivot overhang our property line, road easement and our pens. And I signed no paperwork that told me that pivot came that close and I was OK with it watering the pens. What bothers me is that the pivot owner nor the previous owner mentioned it to me during closing or when we were livestock here that it watered the pens.
I definitely understand about the wind. There’s nothing anyone can do about that unfortunately. But even if you had a strong wind blow in the other way it’s still wouldn’t keep the water out of us
While I believe the seller should have clarified the situation ahead of time, at this point I would say yes, this is on you. This is a problem that literally could have been seen from space. Two minutes on google earth should have revealed that you were buying an encroachment issue. Even more than the seller should have dealt with the issue ahead of time, you should have demanded it be dealt with before signing the papers.
From where I sit you look a lot like the people that buy a house directly off the end of an airport runway and then are all upset that airplanes fly low overhead. Fortunately for you, shutting off sprinklers is cheaper and easier than moving an airport.
