Central Illinois | *Disclaimer* I'm asking as an intellectual exercise, not to start a fight...I always try to get permission to fly my drone above private property.
There have been a few different posts containing the statements that a drone would be shot over such and such property, which got me thinking, how much air space do I actually control? Reading through a few different sources of case law, I found Causby v US Gov where a chicken farmer successfully argued and received compensation for WWII bombers and planes flying over his farm at 83'. I also remember reading about a ruling from the Civil Aeronautics Board stating 87' above the surface, but can't seem to locate it at this point.
As a matter of nuance, there is case law going back to the 16th century that I own ALL of the airspace above my property. The creation of the Civil Aeronautics Board, and subsequently the FAA, gave CONTROL of navigable to the Federal Government. | |
