SE SD | Let me start by telling you that we just aquired this property and I have only met one of the ajoining land owners. I know who a couple are.There are five total. After looking over all property line fences, I have come to the conclusion the fences are in need of attention (they are CRAP). We plan to get a couple bids from fenceing contractors and have our half replaced this early spring. The State of South Dakota law reads the right hand half of fence ,when standing on your property, is yours to maintain. We will have about a mile and a half to replace. My question is, what is the best way to approach these new neighbors ? Do we just put in new fence on our half and not say a word? We have the pasture rented out for the coming season, so if the renters cattle wander,through thier fence, who pays damages? I can forsee one ajoining land owner is going to be , lets say,interesting to deal with. And NO, I will not just put in new fence at my expence, just to get along. This law is on the books for a reason.
