but the passage of time removes the covering dirt..........therefore the burden is essentially on the farmer when he rips below the minimum, and has not done the All-call routine.

The penalty is solely on the farmer/"excavator" for not making the call.

I will see if I can locate the law.......interesting reading since it is so punitive.

There is no penalty on the utility to keep the required "covering" on the pipe.

Might be a civil suit potential.........don't know about that.
