The angle I think most here are missing is that if this generates a sufficient payment for the owner to stop the foreclosure this could possibly work out. The foreclosing bank just wants their note paid off and if your payment will allow the owner to pay off the bank, then the foreclosure will end. Assuming this foreclosure is the only financial problem the owner has then there wouldn't be any bankruptcy judge etc. HOWEVER, the advice of an attorney is still ESSENTIAL in a risky deal like this and I like Jake's idea to have the attorney write down his opinions and suggested actions.
