Options:
1. Accept it.
2. Work with upstream landowner and road commissioner. Friendly-like. What they both did is wet probably actionable, but I’m sure they did what they thought was right at the time. You could call the county engineer and have him look at it, too.
3. Get out your checkbook and get a lawyer. If it is all as you explain, you will win. Slam dunk. But it will take 18 months and about 3-5k.
4. Alternate option, work with NRCS and see if you can get the now-gullied waterway redone including tile.
Frustrating situation as it is difficult to get made whole. As you can imagine, people call me now and call me back when they get to step 3.
I’m still going to look at those terrace files, when I get caught up.
