A neighbor did something similar on me a few years back. Most of the line was in the natural water course, but a bit of it came from the other side of the hill. I was having some other tiling repairs done, so I talked to the neighbor, (who didn't say anything to me about it when he installed it). He agreed to split the $2000 bill for running a new line up there from my main. I think we both left on as good of terms as we'd started with.

I'd start by seeing how much I could get the illegally acting party to pay, but it's likely cheaper to just run a line up to it than fight a court battle over it.
