Panhandle of Ne. | Jim, very sad indeed. But I have a few questions that some of the other posters have mentioned. I was also wondering about the rising sun as another poster stated. Was this a rolling/hilly road? Where was your worker riding on the hiway? I ask these questions because the road I deliver corn to the elevator on has a couple of folks that ride bikes on. They will always ride in the right tire "rut" on the hiway, not on the shoulder. It is a rolling road with gentle curves. I have topped one of those small hills, bike was in the right tire rut and there was an oncoming car so I couldn't get in the other lane to pass. I was driving the speed limit and, fortunately for the bicyclist, I was able to stop in time by smoking the brakes. The ditch was not steep, so that was my second choice. Probably not a good outcome for a loaded semi, but the bike rider wouldn't have gotten hurt. They always wear headphones so they are oblivious to noise.
If the driver was speeding as he was presumed to be doing and none of the aforementioned factors were in play, it should be vehicular manslaughter.
I truly understand a person wanting to get their exercise, but, IMO, should choose a method that would not endanger their lives and their families. Riding a bike on a hiway meant for motorized vehicles, is not a safe method. Once again, just my opinion.
