Isn't right of way only for burial and maint. of pipe... thinking they'd need to talk to landowner about drilling a 400' hole.
Either way I think Mark is right, they were thinking it would just be okay, and they were wrong. If nothing comparable in the area is for sale then they had sure better be able to make it like they were never there. It is thier baby.
