One thing I learned from CCW class, is that the perp HAS to be facing you or it will not hold up in court. They will say the perp was "walking away" and not looking to cause harm, even if they have all ready beaten you within an inch of your life, no matter what they have done, even killed someone all ready. It's up to the cops and justice department after that.
*This also varies somewhat between states.
One lady was raped and beaten, he was leaving her apartment, she grabbed pistol out of nightstand and shot him in the back, she was charged with murder. If she had yelled at him first, and he turned around, she would not have been charged.
