Not really the same as your situation, but we have a RR going through our farm, and always had a private grade crossing. They even rebuilt the crossing once back in the 80's. It got in really bad shape the last few years, so we just ripped it out ourselves and dumped gravel in its place. Works good, and RR never said a word.
