Only way to prosecute in most states is to prove malicious intentional harm from one party to another. We all screw up our words time to time, and an auctioneer can hardly be accused of "directing" his malice upon a certain individual as he has no clue who'll bid the highest. I watched a woman bid up a tupperware bowl that the joker auctioneer said was an "antique".
He let her off, but sh*t it was FUNNY!!
You want a dang warranty [expressed or implied]... go to a dealer.
