I would watch and see if the pony is nipping when brushed in a certain location. Is it maybe mid back or side ect. If it is a particular spot he could be sore there. Maybe kidney infection or back problem ect. both rather common in horses. There could be a reason he is out of sorts.

Granted ponies can sure have an attitude and it isn't uncommon to encounter ones that nip but I would do a good physical and push around on him a bit and see what he does. If he is putting his ears back or tossing his head while you investigate there may indeed be a reason why he is testy. Maybe he is trying to tell you it hurts.
