The former employer cannot keep the employee from making a living.

If the former employer wishes to enforce the non-compete then they need to pay salary to the former employer for X term. It might have ran out anyway, but that is a weird way to word it. Get a customer base after 3 years and then you can go? Usually its a year or two after their last day of work.
