Subject: RE: Settling an estate

central - east central Minnesota -

Farmer71 - 4/20/2014 19:07 Trying to settle a family estate with large family. The estate consists of several tracts of bare land and the home farm (buildings and house). All but one family member are in the farming enterprise. Everything is suppose to be equally split in the future. I'm looking for some bias advice since there is tension amongst the family. Is there professionals that specialize in trusts or estates? The executors have no interest in making time to get it split in the best interest of everyone. Communication has stopped for about a year now.

The ultimate professional is a court Judge . . . . He/She will take care of it, in court.  You can petition the courts to move it along and settle it. Seek competent attorneys for such.

You can fire the executors ..  . it's a process, but their job is to settle the estate and if they are dragging their feet or failing to perform the duty - fire them and get a professional estate or trustee (attorney or CPA) to  handle the affairs and get it cleaned up. It'll take an attorney to do such . . .  .

Yes, there are professional arbitrators that could handle the duties very well . . . start with Ag Credit, as someone pointed out, or ask CPA's that deal in Ag, who've they have worked with or could recommend. A good Ag Bank should have some references also. Keep in mind, executors can be compensated for they duties - so be carefull there, as some will use it as a income stream for several years.
