None compete clauses in Ag businesses?

Let's say a guy works for a coop and signs a non compete clause that states the term is for 3 years from date of signing. His job is to custom apply fertilizer, spray crop protection products and other duties. Three years come and go, end of term on non compete, the employee continues to work pretty much same job for 4 more years.
Employee now wants to change jobs and work for a local BTO applying crop protection products and other duties. Since its been over 7 years since he signed the clause he feels he is in the clear legally. BTO might have him spray some custom acres as well.
The BTO and possible custom customers are not currently and have not been customers of said coop. What are everyone's thoughts?
