NENC | No it isn't unless it is tested by an individual. Every bag of seed that I have ever handled since I was 15 years old said 80% germ. it is only written on the bag at "actual germ" if it is tested by an independent source. here that's the case anyway.
if I'm not mistaken the only thing required by law is that it meets 80% germination. that's why all bags come generic with 80% germ.
