Well hopefully I am still around for a long time but as my will is now they all will get an undivided one third interest in everything and since I was my moms power of attorney to settle my grandparents farm were my mom had an undivided one third interest I have decided that is about the worst way to leave it
I had a friend of mine and his brother got left a nice section of ground that there uncle had that had never married or had kids. The uncle left it to them half and half with undivided interest. They had farmed together since high school. Five years after they got it they were in court and not farming together any more. In the end the farm got sold and either one ended up with it my friend quiet farming and rented his ground out his brother is still farming but not much he has a doctor for a wife. Our estate planner warned us not to leave any ground to folks with undivided interest. |
