I know it is frustrating, but until money is paid he can do whatever he wants with the hay.

Having experience selling hay, I would wager he's probably had dozens of people saying they will buy it for X price, and get it on Y day and never show up.



I was almost selected for jury duty on a trial between a cattle buyer and some cattlemen in a lawsuit. The buyer apparently had claimed they agreed to a deal on the phone, and when it came time to ship, the cattlemen claimed they never agreed to the terms. Buyer was suing for damages he suffered from hedging the cattle he thought he had bought, in the neighborhood of $13k plus legal fees.

I never heard how the trial went, but would be very interested in the outcome. Apparently the judge and the law at least made some allowance for the buyer in that situation.

All the more reason I believe in having things wrote down, and for sure make a partial payment to seal the deal.
