Subject: RE: New Pipeline ROW

I have been dealing with the aftermath of a pipeline for the last 6 years. What I have learned. You need an attorney that specializes in row law. Have a set of definitions for terms like “ag land” and other clauses. Make sure you have a definition that specifies that this is acceptable and this is not. Have a clause to have any court actions held in your location in a local court. If this is crop land you will be unhappy with the results of the installation. If possible encourage them to locate on some other property. Do not accept their first offer, look for land sale info, understand that this land can not be used for certain crops, such as orchards. Make sure that they mitigate all wet land areas to the point that production can occur on them. Pipelines are a nightmare if they effect your land. Also when they ask what crop will be planted on the land choose a crop that has very high value.
