I don't think you will know about the trees until this time next year, at least.  I suspect that they will be ok, but I'd want to know more about what was sprayed.  I admire your patience with the applicator and would suggest that any settlement you negotiate with the insurance should not release them from fault until you know that your trees will make it.  Otherwise, they may say your trees are fine, get a release, and next year you'll be planting new trees.
