Subject: RE: But what about UCR ?

West Union, Illinois

This is where it gets interesting and confusing

no dot number in Iowa if staying inside state and not hauling for hire. I can give you the name of the DOT enforcement officer who told me just yesterday...
You better keep his name on file along with notes about what he told you and when he said it, because it is at least a gray area.  To understand this requires following some legal logic.  That is different than real logic because it involves interpretations and "therefores".  First you need to understand UCR

from http://www.iowadot.gov/mvd/omve/truckguide.pdf page 40

The Unified Carrier Registration System (UCRS) replaced the Single State
Registration Systems (SSRS) in 2007.  The UCRS affects both for-hire and
private motor carriers involved in interstate commerce;

Before you argue with me, I agree with what you are probably going to say.  I contend if I am selling to a local terminal I am not involved in interstate commerce.  The courts have ruled otherwise. If the grain you sell is or may reasonably be expected to be shipped interstate you are a part of interstate commerce.  I don't agree, but my vote wasn't requested.

OK, so unless your grain is going to be fed or processed in Iowa you have to consider yourself the first leg in interstate commerce and have to have a UCR

From http://www.farmbureaunews.com/PDF/United%20Carrier%20Registration%20FAQs.pdf

IF I NEED THE UCR, WILL I NEED THE USDOT NUMBER, TOO?
Yes.  In fact, you will be required to have the USDOT number before you can register for the UCR.  There is no charge to register with the USDOT and it can be done online at https://li-
public.fmcsa.dot.gov/LIVIEW/PKG_REGISTRATION.prc_option
.  The USDOT registration requires that the carrier’s name and USDOT number be displayed on the truck.

So bottom line is, what the Iowa DOT officer told you is true ... sort of. It's true ONLY if none of your grain crosses a state line unprocessed.  But if it does cross a state line you have to have a UCR sand you have to have  DOT # to get the UCR and if you have a DOT number by federal regulation it has to be displayed.

!@#$%^&*()##!
