It's too bad that it's gone on this long without being resolved.  And now with the person gone, it could be a challenge.  In Iowa, I'm relatively sure, it's illegal to dump water on another's land.  I think you probably need to get the NRCS and possibly the FSA involved at this point to figure out the correct solution.  They will know what recourse or solutions you have as options.
