On the last part I can say it depends on the lawyers. Uncle was there and done that. He got all the debt and 1/2 of his shop/business, she got everything else.
So naturally she sold it all and moved to Mexico. Then tried to come back again with some "emotional distress" thing and this time he chose a different lawyer and actually got about half the debt off of him.
Divorce thread below got me thinkin.......
