You need to fence to keep them out unless they are habitually out. That sets a pretty high standard. Potentially you could build a history of them being out and then you are due damages but remember that you have to prove a damage too, you don't just get to say I want so much and that's that.
Looks to me like it might be best for you to put up an electic fence to keep them out.
