You wouldn’t have to be a vet, but if it’s considered “practice of veterinary medicine” then getting paid to do it would be practicing without a license.

If it’s not considered practice of vet medicine under the state practice act, is there a duty by the state to license ultrasound technicians? Most states license beauticians who’s worst mistake would probably result in a “bad hair week” for somebody. The stakes of incompetent pregnancy diagnosis are considerably higher.

The Pennsylvania state board of vet medical has been trying to assert their jurisdiction over this practice but these guys haven’t backed down. So the state board exercised their levers of power and got arrest warrants. The warrants were executed and now the two guys are sitting in jail.

Did the state board have that power? Is ultrasound diagnosis of pregnancy in animals practice of veterinary medicine? Now it’s time to find out in the courts. And of course the state legislature may amend the practice act if they wish, so that is always an option no matter what the courts decide.

Like I said before, lawyering up before things got this far might have kept them out of jail. It’s rare that people “blow off” a state agency without consequences.
