So how would a guy write that in a contract to protect owner of cattle in situations like this?
Ad a provision that feed lot is responsible for death loss greater than X%
You will likely have to allow them to reject incoming cattle they feel are susceptible to death or identify them as outliers that can not be used in the death loss percentage calculation.
