The farmer is still liable even if his insurance won't pay. I would like to think if I was the guy that caused you harm I would pay and then sue my insurance or Monsanto. If he were to admit the damage came from him it seems they would have to pay. I guess I would ask him if he really wants to be that guy that doesn't accept responsibility for harming his neighbors. How would he feel if the situation was reversed?
