Pocahontas County, IA | How deep is your tile?
Demand pipeline be installed 5 feet deep so it does not interfere with any additional tile you may install. Make certain the easement allows you to install tile above pipeline.
Any tile that is cut should be replaced by hard pipe through the area of disturbance plus a distance into undisturbed land. This helps with settling of soil and creating a low spot in the installed tile. Either hire an inspector, at pipeline contractor's expense, to be on site while they are digging on your property or insist that you be allowed to do so. If an inspector, make sure he has your tile maps or if it's older tile make sure he is aware where they could be. Tile must be fixed to your satisfaction and for several years beyond the end date of the project! Sometimes problems do not show up right away.
If there are district tile systems in your county, the county will be insisting on an inspector for any drainage district tile. Make sure that inspector is also looking out for private systems. Talk with your county supervisor.
Demand fair market value for the easement. Demand 3 years gross profits like 2021 profits from the area of the easement. It will take that long to begin to get land back in shape. The same fee should be charged for any traffic outside the 50 foot easement.
Demand 1 years profits for the rest of the field you can not use because of installation plus costs for seeding cover crop for the year.
There may be costs involved for finding another place for the hog manure. Document that. Ask for double the amount. Your fertility program has been effected. Document that in current fertilizer values. Ask for double.
It is important to able to document any "costs" for damages that this project creates.
Good Luck!
