Respectfully, your question about necessity is not relevant because it is our right specifically enumerated in the Bill of Rights.

Our constitution and root legal approach is that rights are inherent to our citizenry and only given to the government as is specifically written. The first ten of our inalienable rights is so important that we specifically list them so that the government is reminded not to infringe upon them.

Contrast this approach with that of many other countries, where the government has all the rights and citizens are only given certain rights. This is why the EU and the UN natter on and on about universal basic human rights - because their legal systems are not predicated on limited governmental rights, but limited rights of citizens.

US citizens acknowledge that there are folks who live under such a strange system, but we would never accept living under such a system ourselves.
